Edinburgh couple lose Narnia website battle
BRIAN DONNELLYJuly 23 2008

An Edinburgh couple who bought a Narnia website name for their son's birthday have lost their David and Goliath-style battle against one of the biggest law firms in the world.

Richard and Gillian Saville-Smith bought the name www.narnia.mobi for £70 for their 11-year-old son Comrie, who is a fan of the C.S. Lewis books.

But they ended up in a legal fight with C.S. Lewis (Pte.) Ltd, the firm that owns the author's estate, which wants the website name.

Baker & McKenzie, the lawyers representing the company, claimed Mr and Mrs Saville-Smith had been using the domain in "bad faith" to make money - a claim they deny.

A complaint was been lodged with the World Intellectual Property Organisation (WIPO) which has now ruled against the Scottish couple.

Mrs Saville-Smith's said today: "It should have been pretty straightforward.

"They had to prove that we had made a bad faith purchase, that we had been using it to make money.

"We provided very clear statements from the internet registration company saying that we had not tried to make any money and yet somehow it has just simply ignored the evidence.

"We have not done anything illegal or wrong, we were perfectly entitled to have this domain name."
