Revealed: CIA offered $2m to Lockerbie witness and brother

The CIA offered $2m (£1m) to the Crown's key witness in the Lockerbie trial and his brother, sources close to the case have told The Herald.

Recently discovered papers show Scottish police officers investigating the 1988 bombing were aware the US intelligence service had discussed financial terms and witness protection schemes with Tony Gauci and his brother, Paul.

They documented the talks and it would have been standard practice for such information to have been relayed to the prosecution team before the trial of Abdelbaset Ali Mohmed al Megrahi, the Libyan serving 27 years for the bombing.

However, his defence team was never told of the CIA offer, in what critics say is another example of non-disclosure that undermines the credibility of Mr Gauci and, in turn, the Crown's case against Megrahi.

It has not been confirmed that the brothers accepted any money, but the fact that an offer was made is directly relevant to the credibility of Tony Gauci, who became the lynchpin of the case. Paul was never called as a witness.

The latest remarkable twist comes a day after The Herald revealed a top-secret document vital to the truth about Lockerbie was obtained by the Crown but never disclosed to the defence.

The Scottish Criminal Cases Review Commission found that document during its three-year investigation, which concluded earlier this year that Megrahi should have a fresh appeal.

The document, thought to be from the CIA, contains highly classified information about the MST13 timer which allegedly detonated the bomb. The Crown, for national security reasons, is still refusing to hand the material over to the defence.

An offer of remuneration by the US agency could be explained by the political imperative then for the US and Britain to secure a conviction for Lockerbie. At the time, Libya was very much a hostile nation, unlike the more relaxed links between Tripoli and the West which now prevail.

Yesterday in Edinburgh, the defence lodged its case with the appeal court and a preliminary hearing has been set for a week tomorrow.

The defence team also lodged a specification of documents order, demanding the Crown release the classified document. Prosecutors are expected to challenge the appeal, despite the weight of new evidence.

A source close to the case said: "We understand the commission found new documents which refer to discussions between the US intelligence agency and the Gaucis and that the sum involved was as much as $2m.

"Even if they did not receive the money, the fact these discussions took place should have been divulged to the defence."

The Herald has also seen copies of an agreement with the US government and signed by a senior member of the Crown Office, agreeing not to disclose certain material.

Norman McFadyen, then one of the leading members of the prosecution team and now the Crown Agent, signed the non-disclosure agreement on June 1, 2000.

James Chalmers, a senior lecturer in law at Edinburgh University, said if a member of the Crown agreed not to disclose material shown by a foreign government, it called its worth into question.

"This would raise questions about whether the right to a fair trial has been breached. And if a witness were offered money before giving evidence, this could undermine their credibility.

"It would certainly need to be put to the witness under cross-examination. If such information was not disclosed to the defence, that could give rise to a miscarriage of justice. It is an issue of credibility."

Dr Jim Swire, whose daughter Flora died in the tragedy, said: "It is shocking to me that if after 19 years of trying to get to the truth about who murdered my daughter, national security is being used as an excuse."

A spokesman for the Crown Office has previously declined to comment on the case saying it would be "wholly inappropriate" while it is before the appeal court.

That isn't news, it's history. Some folk well know how to uncover erm secrets by digging for same .To be in possession of such erm documation, complete with impecable resourses for it to be relied on. as kosher . Besides I would prefer my front door to remained attached to its hinges.

Isn't is amazing of many folk in public services seem to be a bit disgruntled these day? No telling what some folk will aid in revealing if they're a bit disgruntled,eh?

The truth is out there and as time passes documentation has a habit of being lost or whatever. The problem for some folk is it may become unlost..

More troubling is the realisation that our government officials and Scotland's leagal team knew a lot more than they admit, and yet went along with the cover-ups.

It is just possible that the offer of several million dollars by the CIA--even if it were not accepted--might convince most people that they had better give their tetemony in a certain way that was favourable to the CIA, given that organisations track record of killing those who did not fit in with it's plans.

Mr Gauci might have been afraid that he would be given a Castro type cigar and decided to play ball!

On a serious note what is most worrying is the fact that Scottish police officers investigating the 1988 bombing were aware the US intelligence service had discussed financial terms and witness protection schemes with Tony Gauci and his brother, Paul--yet kept this from the defence.

'The document THOUGHT to be from the CIA' Actually I doubt very much if it's true. More than likely it's some folk within the government trying to find some way to release the bomber to gain access to more Libyan oil contracts. They probably had someone type something up not long ago. I have a feeling no one will risk their careers to question it. The guy will be released and we will become best buddies with Gaddafi's oil rich regime.

The truth is whenever you see a headline making a statement of fact, then in the article read the word 'sources', you have to take it with a pinch of salt. It's usually called a conspiracy theory, on a par with what I've just written. ;)

The fact is that I care much less about any Libyan oil arrangements than about the integrity of the legal system in Scotland. IF we were to lose that we have nothing,and become little more than the worst banana republic where money and knowing the right people can get you away with anything.

Here are a couple of interesting articles. This guy had it right in 1987 but couldn't get published until 2004.

“Another looming concern is Iran which wants to develop nuclear weapons to couple with their Shahab 4, 5 & 6 missiles on the drawing boards which have a range to hit London, Israel, all of Europe, southern Russia and the United States. Also, the Iranian government has said it initially had 300 centrifuges to enrich uranium to weapons grade material. They have increased that to 3,000. They will soon increase that again to 10,000 centrifuges,” Spirko says. “They have the additional capacity to add another 20,000 centrifuges in mass production techniques that will enable them to produce at least seven nuclear bombs in about a year. Where did they get these centrifuges?”

Spirko answers that question by stating an Arab proverb, “The enemy of my enemy is my friend.”

“Simply put,” Spirko explains, “they probably got them from Saddam Hussein before the Iraq War started and were probably smuggled out of Iraq and into Iran just like he did his air force of 600 Soviet fighter planes. In other words, he gave them to his former enemy rather than let them be destroyed on the ground.”

“Why would he have done any differently with the 30,000 centrifuges he supposedly had on a decentralized basis inside Iraq before the war?” Spirko asks. “Isn’t it strange that Iran could come up with a nuclear weapons program in about six months to a year when it took the United States six years under the Manhattan Project with 5,000 of the world’s most brilliant scientists like Robert Oppenheimer, Niels Bohr, Seaborg, Einstein, Fermi, and others working on it?”

Another point Spirko makes on the Mideast is that, “It is time for the Israelis and Palestinians to return to the Camp David Peace Talks or some other place, resume where they left off and "freeze in place" the already-agreed-upon negotiating points,” Spirko says.

"And, it's all related to the Palestinian-Israeli conflict which I said back in 1987 was the crux of my book. It always has been, and always will be until it's settled,” Spirko says. “That linkage is exactly what Osama Bin Laden stated in a taped message aired the weekend before the election in November of 2004. Whether you believe him or not is beside the point. That's what's he told us, and we'd better take that into account."

Same Defence QC
Same Questions:
Why wasn't Crucial Key Forensic evidence called?
Why wasn't Crucial Crown Witnesses called??
Why did Taylor QC close my Defence without my say so???
Why did he not call Lawyer who said: Police had Number 2 out his mouth before turning to view ID Parade.
Why did SCCRC accept Taylor saying he did not know about Lawyers evidence, Despite Lawyer being on my defence list.
SCCRC even refused to answer when asked why my defence team never called the Lawyers Evidence.
Why was my defence Team allowed not to interview 16 Defence Witnesses and 6 crown Witnesses. SCCRC did not even ask them why they never interviewed my witnesses before trial.
Was all these failings because when i went to SCCRC they allowed Taylor to remain on their Board but when Megrahi Appealed Taylor resigned to allow them to remain Independent and Impartial.
Was i not entitled to the same Indepence and Impartial review of my case.

What is even more alarming is i am asking for witnesses statements That gave Evidence so their statements are public Knowledge.
See Crowns letter dated 22 march where they use Public Interest test and Data Protection rules to not release documents to me.
Not any surprise to see they have done the same with Megrahi.

Crown decide what is to be released, despite Privy Council in the Holland and Sinclair cases saying all evidence must be released.
Megrahi will always have an appeal to Privy Council.

Here is a Foreign National having Two appeals in our Country (Quite Rightly too) Yet I am Denied even One Appeal.
Everyone has the minimum right of Appeal yet our Courts are denying me this Human Right but allowing a Foreigner better access to Justice.
What is our Justice System coming to?

Any Junkie or Grass would bite the arm off of them for £2M

The Wacky Races would start and there would be fights galore among them all.
Contracts for Murder, we hear every day are taken out on people for fractions of £2M so no surprise they managed to get false evidence from Gauci

You are so full of ****, and you know it. Do you not think that the Commission which studied this for three years would have said something about the CIA paying off the witness? The Commission found the opposite - that all your conspiracy stories were without any basis and not to be believed.

'Golfer has also revealed that an undeclared American passport was found among the masses of debris recovered after the atrocity. He said it had been issued to Khaled Jafaar, known to have been involved in controlled drug runs that the CIA was allowing to happen.

There were early suggestions that he may have unwittingly carried the bomb on board, believing that he was carrying a suitcase concealing drugs. But it emerged later that he was in the service of the CIA.

Golfer makes it clear that most of his colleagues were entirely committed to pursuing a case against the first suspects, the PFLP-GC, and could see no reason to deviate from that path when they were instructed to look to Libyan involvement.'
